Since 2020, the EU&#8217;s initiatives such as the European Data Strategy and Digital Finance Strategy have advanced efforts to regulate data collection, handling, and exchange. In line with these objectives, the EU proposed the Financial Data Access Regulation, complementing the Regulation (EU) 2023\/2854 or \u201c<strong>Data Act<\/strong>\u201d, which entered into force on January 11, 2024.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><br><\/strong>Scope of Application \u00a0<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">The draft Financial Data Access Regulation (\u201c<strong>FIDA<\/strong>\u201d) establishes, in Article\u202f2(1), a mandatory data\u2011sharing framework that extends well beyond payment\u2011account information. Covered datasets include, <strong><em>inter alia<\/em><\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">customer data on savings, investments in financial instruments, insurance\u2011based investment products, and crypto\u2011assets;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">information collected for corporate credit\u2011worthiness assessments; and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">records concerning pension entitlements of any kind.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">FIDA applies whenever one of the entities listed in Article\u202f2(2) acts as a data holder, a data user, or both. The catalogue embraces investment firms under MiFID\u202fII<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>, credit institutions, payment\u2011 and e\u2011money institutions, insurance undertakings, crypto\u2011asset service providers, and issuers of asset\u2011referenced tokens.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Notably, issuers of other MiCAR tokens (i.e. <em>non\u2011ART\/EMT<\/em> tokens) are not <em>expressly<\/em> covered.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cCustomer\u201d is defined broadly: it may be a consumer or any natural or legal person that uses financial products or services. Hence, the Regulation governs both B2B and B2C relationships. FIDA also exhibits marked extra\u2011territorial reach. Third\u2011country investment firms wishing to act as financial information service providers (\u201c<strong>FISP<\/strong>\u201d) in the EU must (a) obtain the dedicated authorization under Article\u202f12 and (b) establish either an EU subsidiary or appoint an EU\u2011based legal representative (Article\u202f13).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><br><\/strong>Key Actors and General Rules<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Data\u202fholder<strong>: <\/strong>any financial institution (other than an account\u2011information service provider) that collects, stores or otherwise processes the datasets listed in Article\u202f2(1).<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Data\u202fuser: any entity listed in Article\u202f2(2) that, with the customer\u2019s permission, lawfully accesses those datasets.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Financial Information Service Provider (FISP): a data user specifically authorized under Article\u202f14 to access customer data for the provision of \u201cfinancial information services\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">FIDA foresees a uniform contractual model between data holders and data users, embedding:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">minimum remuneration obligations: a <em>reasonable<\/em> fee schedule for making data available (Article\u202f10(1)(h));<\/li>\n\n\n\n<li class=\"has-medium-font-size\">standardised allocation of liability; and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">a built\u2011in dispute\u2011resolution mechanism.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">There are many obligations under FIDA, including but not limited to: (i) customer must explicitly instruct the data holder to share data with a chosen data user; and (ii) very data holder must offer a permission dashboard that complies with the formal, functional, and accessibility criteria in Articles\u202f8 and\u202f10(g). Through that dashboard the customer can grant, monitor, and withdraw permissions in real time. In addition, customers are entitled to obtain, via the dashboard, a copy of all FIDA\u2011scope data held about them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><br><\/strong>Sanctions and supervisory powers<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Besides the conventional and potentially high administrative fines, competent authorities may impose recurring penalty payments that continue until the breach is remedied (de facto \u201c<em>astreinte<\/em>\u201d).<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Each Member State must designate a dedicated supervisory authority. Its toolkit mirrors modern EU enforcement practice and includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">on\u2011site inspections, the questioning of staff, and data seizure;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">orders to hosting or telecom providers to remove, disable, or restrict access to online interfaces; and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the ability to levy both lump\u2011sum fines and periodic penalty payments.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Where breaches persist, authorities may deploy escalatory measures up to, and including, operational shutdowns of interfaces, which could generate severe business disruption.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><br><\/strong>Timeline and Entry into Force<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">The current draft is expected late\u202f2025. Under Article\u202f36 of FIDA:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">the bulk of the Regulation applies 24\u202fmonths after its entry into force; and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">provisions on Financial\u2011Data\u2011Sharing Schemes and authorization requirements for FISPs apply after 18\u202fmonths.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Market participants therefore face a relatively short implementation window once FIDA is published in the <em>Official Journal<\/em>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong><br><\/strong>Lexify as Your Consultant<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Lexify is among the first law firms to analyze FIDA\u2019s legal and economic impact in depth.
