{"id":2020,"date":"2025-07-22T12:00:50","date_gmt":"2025-07-22T12:00:50","guid":{"rendered":"https:\/\/lexify.io\/?p=2020"},"modified":"2025-07-22T12:00:54","modified_gmt":"2025-07-22T12:00:54","slug":"eu-commission-guidelines-on-gpai","status":"publish","type":"post","link":"https:\/\/lexify.io\/de\/eu-commission-guidelines-on-gpai\/","title":{"rendered":"GUIDELINES ON GPAI UNDER THE AI ACT"},"content":{"rendered":"<h3 class=\"wp-block-heading\">Introduction &nbsp;<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">With the adoption of Regulation (EU) 2024\/1689 (the \u201c<strong>AI Act<\/strong>\u201d), the European Union has introduced a horizontal framework governing the entire life\u2011cycle of artificial\u2011intelligence systems. Article 96(1) of the AI Act mandates the Commission to issue guidelines clarifying the practical application of the Regulation (the \u201c<strong>Guidelines<\/strong>\u201d). The Guidelines cover four <em>core<\/em> areas: definition of a GPAI model (Section 2);identification of the provider placing a GPAI model on the market (Section 3);exemption conditions for certain models released under an open\u2011source license (Section 4); and enforcement methods and compliance timelines (Section 5).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> <strong>When is a model qualified as GPAI?<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">A model is generally considered GPAI if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">the training compute exceeds 10\u00b2\u00b3 FLOP (\u201c<strong>Floating Point Operations<\/strong>\u201d);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">it is capable of generating language (text or audio) or visual content (text to image or text to video);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">it displays significant generality, i.e. it can competently perform a broad range of distinct tasks.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">A model that surpasses the 10\u00b2\u00b3 FLOP threshold but is confined to a single purpose (e.g. pure speech\u2011to\u2011text transcription, image upscaling, inpainting, etc.) <strong><em>may not<\/em><\/strong> fall within the GPAI category, absent the required generality.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The GPAI life-cycle and related obligations<\/strong><br><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">The life\u2011cycle of a GPAI begins with the first large pre\u2011training run. From that moment, the provider must comply with the obligations provided by the AI Act including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">prepare and keep up to date the technical documentation (Art.\u202f53(1)(a)\u2011(b) AI Act);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">adopt an EU copyright\u2011compliance policy (Art.\u202f53(1)(c));<\/li>\n\n\n\n<li class=\"has-medium-font-size\">publish a public summary of the training data (Art.\u202f53(1)(d)); and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">for GPAI with systemic risk (>10\u00b2\u2075 FLOP or designated by the Commission), carry out continuous risk assessment, mitigation and reporting of serious incidents (Art.\u202f55).<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">These measures must span the entire life\u2011cycle of the model, including any subsequent re\u2011warm or fine\u2011tuning stages after it is placed on the market.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Who is (and when it becomes) the <em>provider<\/em><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">A provider is the person who develops, or has developed, a GPAI model <strong><em>and<\/em><\/strong> places it on the Union market for the first time, whether for payment or free of charge. Placement can occur, <em>inter alia<\/em>, via:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">software libraries, packages or public repositories (e.g. direct download);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">APIs or cloud services;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">on\u2011premise or edge distribution; or<\/li>\n\n\n\n<li class=\"has-medium-font-size\">integration in chatbots, mobile apps or core internal services delivered to third parties in the EU.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Where a GPAI model is developed by multiple natural persons or legal entities, the provider is deemed to be the actor that assumes overall leadership of the project, <em>i.e.<\/em> the project coordinator. The Commission nonetheless keeps a degree of flexibility, stressing that such scenarios, undoubtedly among the most debated and delicate, must be examined on a case-by-case basis. In every instance, the assessment must be anchored in the definition of \u201c<em>placing on the market<\/em>\u201d set out in the Blue Guide.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The AI \u201cproduction line\u201d typically involves a network of actors who contribute not only to the development but also to the availability of the software. Paragraph 59 of the Guidelines is therefore crucial: \u201c<em>The upstream actor should then be considered the provider of the model, unless the upstream actor <strong><u>has excluded, in a clear and unequivocal way<\/u><\/strong>, the distribution and use of the model on the Union market, including its integration into AI systems that are intended to be placed on the Union market or put into service in the Union<\/em>\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Where a GPAI is embedded in an AI system that thereby becomes itself \u201cgeneral\u2011purpose\u201d, it is necessary to distinguish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">the original provider of the model, responsible for GPAI\u2011specific obligations; and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">any downstream modifier who introduces significant changes to the model.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">A strong indicator to consider the modifier a <em>provider<\/em> is when the training compute used for the modification <strong>exceeds one\u2011third of the original model<\/strong>. If this value is unknown, the one\u2011third threshold applies to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">10\u00b2\u2075 FLOP if the base model already has systemic risk; or<\/li>\n\n\n\n<li class=\"has-medium-font-size\">10\u00b2\u00b3 FLOP in all other cases.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Open-source exemption: key conditions<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Providers that release the model under a free and open\u2011source license and make publicly available the parameters, weights, architecture and usage information are exempt from certain obligations namely:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">drafting\/updating technical documentation for the AI Office and for downstream actors (Art.\u202f53(1)(a)\u2011(b)); and<\/li>\n\n\n\n<li class=\"has-medium-font-size\">where applicable appointing an authorized representative in the EU in accordance with Art.\u202f54.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">The exemption does not apply if the model:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">is classified as GPAI with systemic risk;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">is distributed under licenses restricting use (<em>e.g.<\/em> research\u2011only or non\u2011commercial terms) or imposing fees or personal\u2011data collection as a condition of access\/use; or<\/li>\n\n\n\n<li class=\"has-medium-font-size\">fails to publish the complete technical information required for integration.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Even where the exemption applies, the provider is still required to comply with the applicable provisions including the adoption of a copyright\u2011compliance policy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Lexify as Your Legal Advisor<\/h3>\n\n\n\n<p class=\"has-medium-font-size\">The Guidelines provide an operational roadmap for all stakeholders in the AI value chain, clarifying qualification criteria, scope of obligations and possible exemptions.
